Divorce in the United Kingdom: What are the Grounds?
Upon entering into a contract of marriage, both parties should have a good grasp of their legal responsibilities so they do not end up hating each other and then spending a fortune for a lawsuit just to put an end to their union. Nonetheless, if things do turn sour, it is equally important to know what grounds they can possibly claim in a court.
The basic argument for the action is irretrievable breakdown of marriage, which may be proven by establishing any of the following facts:
- Adultery – Whether through adequate circumstantial evidence or actual admission, you must prove that sexual intercourse has happened between your spouse and another person. Additionally, you must find it intolerable to continue living with your partner. It is, however, not essential to name the third party as a co-respondent. In fact, the omission will not have serious legal consequences on the case.
- Unreasonable Behaviour – A common ground used by married couples in the UK, this must have prevented you to continue living with the person. In a suit stating this argument, you may also set out several other allegations against the respondent.
- Desertion – This is used in cases where one of the contracting parties abandons the union without the other’s consent. However, it must be for a minimum period of two years. Scotland has just recently abolished this cause since it is almost never used.
- Separation – Here, both the spouses must have not been living together for at least two or five years. If it is the former, both must agree to the petition. If it is the latter, there is no need to seek the other party’s consent to the divorce.
